About the Organization

The Central Bureau of Investigation (CBI) is India's premier investigating agency functioning under the Department of Personnel and Training (DoPT), Government of India. It investigates corruption cases involving Central Government employees, major economic offences, bank frauds, cybercrime, special crimes, and other high-profile criminal matters. Apart from conducting investigations, CBI also represents the Government of India before various courts through appointed legal counsels.

The Anti-Corruption Branch (ACB), Kolkata has released this notification to engage experienced advocates as Special Public Prosecutors (Retainer Counsels) for representing CBI before the Hon'ble High Court at Calcutta in matters arising from CBI investigations.

About the Post/Opportunity

CBI has invited applications from eligible advocates for engagement as Special Public Prosecutors (Retainer Counsels) at the Hon'ble High Court at Calcutta. The selected counsels will conduct prosecution in criminal cases investigated by CBI and represent the agency in appeals, revisions, writ petitions, bail matters, and other miscellaneous legal proceedings before the High Court.

The appointment is purely contractual and the selected advocates will be engaged for a period of three years, subject to the terms and conditions prescribed by the Government of India. The remuneration will be governed by the latest DoPT guidelines issued for Special Public Prosecutors engaged by CBI.

CBI intends to engage four (04) Special Public Prosecutors (Retainer Counsels) for representing the organization before the Hon'ble High Court at Calcutta.

Roles and Responsibilities

Selected candidates will be responsible for:

- Conducting prosecution in criminal cases investigated by CBI before the Hon'ble High Court at Calcutta.

- Representing CBI in appeals, criminal revisions, writ petitions, bail applications, and other legal proceedings.

- Drafting legal documents including petitions, replies, written submissions, and grounds of appeal.

- Providing legal opinions and assistance to CBI whenever required.

- Appearing on behalf of CBI in miscellaneous matters related to CBI before the High Court.

- Ensuring effective presentation of evidence and legal arguments to safeguard the interests of the organization.

- Performing all duties in accordance with Government of India guidelines and the professional standards expected from a Special Public Prosecutor.

Eligibility

Applicants must satisfy the following eligibility conditions:

Educational Qualification

- Must possess a Bachelor of Laws (LL.B.) degree from a recognized university.

Enrollment

- Must be enrolled as an Advocate with the Bar Council of Calcutta High Court.

Professional Experience

- Must have substantial experience in handling criminal matters before subordinate courts and the High Court.

- Must possess at least 10 years of experience as an Advocate with significant exposure to criminal litigation.

Other Requirements

- Should be willing to work under the terms and conditions prescribed by the Government of India.

- Experience in conducting criminal prosecutions, especially in High Courts, will be an advantage.

Salary/Perks

The professional fee will be paid as per the revised DoPT guidelines

- Annual Retainer Fee: ₹50,000

- Daily Appearance Fee (Kolkata): ₹15,000 per case per day

- Drafting Fee: ₹5,000 per case for drafting petitions, replies, appeals, pleadings, etc.

- Clerkage: 10% of the daily fee, subject to a maximum of ₹30,000 in a case or batch of cases.

- Out-of-pocket Expenses: ₹1,000 per case or batch of cases till final disposal, payable on submission of bills.

The engagement also provides an opportunity to represent India's premier investigating agency before the High Court, thereby enhancing professional exposure and litigation experience.
