ASD v. LCSIBD Supreme Court on Women’s Career, Cruelty & Divorce
In ASD v. LCSIBD, the Supreme Court held that a wife’s decision to pursue her professional career and establish her independent identity cannot be treated as matrimonial cruelty. The case arose after the Family Court granted divorce on grounds of cruelty and desertion against the wife, a qualified dentist married to an Army officer. The Supreme Court observed that expecting a woman to sacrifice her career and conform to traditional notions of an obedient wife was archaic and legally unsustainable. While the Court upheld the divorce on the ground of irretrievable breakdown of marriage, it expunged findings of cruelty and dismissed the husband’s perjury plea.

"The parties were married in 2009. The appellant-wife was a qualified dentist, while the respondent-husband was serving in the Indian Army and was posted at Pune... Subsequently, after the husband was posted at Kargil, she shifted there and stayed with him for over four months... she conceived... returned to Ahmedabad... After the birth of their daughter, the wife again went to Kargil with the child. However, when the child developed seizure episodes... parties returned to Ahmedabad... The Family Court ultimately granted divorce on grounds of cruelty and desertion attributed to the wife... The husband sought prosecution of the wife for perjury."
